Two women serving sentences at Edna Mahan Women Jail in New Jersey, USA, have become pregnant after engaging in sexual intercourse with transgender, male-born female inmates.
Authorities said the unidentified inmates were involved in “consensual sex with another inmate” at the Edna Mahan plant, said U.S. Prison Director Dan Sperrazza.
It was not clear whether it was the same or different transgender prisoners, in a prison where at least 27 transgender ‘women’ are being held among about 800 prisoners.
Sperrazza added: “The institution can not comment on disciplinary actions taken after the event but the department reserves the right to ensure the health and well-being of all imprisoned individuals.”
Last year New Jersey launched a policy of housing inmates ‘according to their preferred gender’ even after undergoing gender reassignment surgeries.
The policy came after a lawsuit filed by a transgender (male turned female) after she was forced to live in men’s cells for several months.
Condemning the policy of allowing transgender people in the women’s prison Edna Mahan, the head of the union said: “We oppose this policy that harms the general population of women housed in the facility.”
Legal director Jeanne LoCicero defended the policy, saying “transgender rights must be protected” even though they had left pregnant women incarcerated at the facility.
She told the network NJ.com“Under New Jersey anti-discrimination legislation based on gender identity this is the actual procedure,” she said without providing a solution to the concrete problem of sexual interaction.
