The Supreme Court has decided to overturn the recourse of the former Minister of Defense, Fatmir Mediu, against the decision of the Special Court of Appeals that paved the way for his retrial and trial in the Gërdeci case.
When submitting the appeal, lawyer Ardian Visha argued that the decision was unconstitutional and violated the principle of the adjudicated matter, as long as a request for retrial was previously rejected by the Tirana Court and its Appeal.
The Special Prosecution against Corruption and Organized Crime (SPAK) registered criminal proceedings against former Minister Fatmir Mediu, in the Gerdec case for the criminal offenses: “Abuse of duty”, committed in collaboration, and “abuse of duty” in cooperation with military entity, command staff.
Mediu is accused of abuse of office in connection with the Gerdec tragedy, where 26 people were killed and hundreds injured in the explosion of a weapons dismantling workshop.
Mediu through his lawyer claimed that the decision was in violation of the law, of the principle of the adjudicated thing, referring to the fact that a smaller court overturned the decision of the High Court.
