In the hearing with representatives of lawyers, the Minister of Justice, Ulsi Manja, expressed his determination to approve the new judicial map. While clarifying the procedure followed, Manja said that the new judicial map will be passed to the Council of Ministers, as soon as the report of the Ministry of Finance on its costs arrives. Regarding the stock of files in the court, Manja brought to attention Italy, which for many issues refer to alternative justice.
“We came out of respect for the assembly and the citizens. I came with the thought that you will hold me accountable for not following the law. The map was an obligation, since the KLJ was created late, the work on the map started in 2019 and it went to the Minister in September 2020. The 2016 Law does not have an unlocking mechanism. The map is an attribute of the KLGJ, the law says it clearly, the map as a technical product of the KLGJ that has a long process as it is drawn up is there for the budgeting and logistics that this map should have. To answer Felaj, lawyers represent clients, not citizens.
The map is not bolt clean. Suggestions were also received from the lawyers. Two public consultations with lawyers were carried out in 2016. Today, the map is a matter of law enforcement. As long as the law is in force, the minister has the obligation to support the new map of the judicial system.
I received the map product in December 2021, Revised after making some suggestions about the map. If we take the new trends, 17,200 citizens have addressed the court. In the existing buildings, one stop shop type services will be offered to citizens, and I have found agreement on this. In December 2021, according to the law, it was launched as co-authorship of KLGj and the Minister of Justice. The lawyers have been heard, they have had suggestions, but this does not mean that all suggestions are taken into consideration. We are limited by law.
KLP has brought a positive assessment for the map, the general prosecutor as well, the Ministry of Finance is costing the new judicial map, which will extend the effects after coming into force. Of course there are costs. As a government, we are seeing if we have the budgetary possibilities.
As soon as the report comes from finance, we will pass it to the council of ministers for approval.
The map does not take into account the stock, it is not a problem that arose today, nor vetting. Harta has made the judicial reorganization for the 408 judges it has today according to the decree of the president. So we are distributing 408 judges. Stock yes, it’s a problem even in EU countries, there is a problem with stock, but they preceded it by finding ways in the direction of alternative justice, one of them was mediation.” said Manja, while also commenting on the lawyers’ boycott.
“Protest, or boycott, or strike, I don’t know what they called it, the functioning of the justice system has a key role. The process does not work without the lawyer. Lawyers have limited right to strike. The right to strike is also limited for lawyers. Very soon I will turn to the legislator for a change in the lawyer’s law, just like the magistrates,” said Manja.
