The family of a British heiress who lost her life while on holiday has won the right to sue her husband for murder as well as for the payment of 3 million pounds of life insurance.
Paula Leeson, 47, from Sale in central Britain, died drowned in the pool of a villa in a remote Danish village in June 2017, while on holiday with her husband Donald McPherson.
The latter was charged with her murder in 2020, but the trial in Manchester was abandoned after the judge ruled that there was not enough evidence.
McPherson was already expecting 3 3.3m from insurance as a result of his death but Leeson’s family is pursuing a civil murder lawsuit.
Chief Justice Pearce, rejected McPherson’s claim to stop the trial and ordered Manchester police to disclose the documents they possess in aid of the family’s claims.
But McPherson, who has already settled in New Zealand, has once been acquitted of murder.
Mrs. Leeson was the daughter of Willy, a successful businessman who ran an engineering company in Manchester.
Lawyer Alison Rocca said: “The Leeson family are delighted that Donald McPherson’s efforts to dismiss the lawsuit have been overturned. “His placement in New Zealand will not allow him to escape the consequences of his actions.”
“The family is now closer to achieving justice for the untimely death of their daughter.”
The hearings are expected to begin in March.
