The Special Court of Appeals for Corruption and Organized Crime on Friday ruled in favor of former Interior Minister Saimir Tahiri. The court upholds the first instance decision, with the change that Tahiri will serve in prison the sentence of 3 years and 4 months of imprisonment.
Following the decision, the former minister was escorted to Prison 313 in Tirana.
Tahiri was initially sentenced to five years in prison, but due to the shortened trial will serve three years and four months in prison.
Tahiri’s imprisonment begins on the day of the execution of this sentence and is carried out in an ordinary security prison.
The former Minister of Interior, reacted immediately after the decision was given on Facebook, emphasizing that he has never violated the law, and considered the court decision as unfair.
“I love you all. I’m sorry it went that way. I am morally calm, I have never broken the law, I have loved every day of my work, I am happy to have done my duty as best I could. It is simply injustice“, Writes Tahiri.
The Special Prosecution SPAK had requested 12 years in prison for Tahiri.
This case has dragged on for five years in the ranks of many courts.
SPAK demanded 12 years in prison for Tahiri and former police director Jaeld Çela. On the other hand, the defense demanded that Tahiri be acquitted.
The “Tahiri” case was registered in this GJKKO on November 26, 2021.
It was previously in charge of the Supreme Court. The latter clarified the decision on the case of the former minister, where it was argued that there were procedural violations during the trial of him and the former director, Jaeld Çela.
The court decided to overturn the decision of 26 June 2020 of the GJKKO Appeal and send the case for reconsideration to this court with another panel. The Special Appeal, in its decision, at that time said that the provisions for filing new charges were violated, related to the non-compliance with the provisions for the prosecution by the prosecutor.
It was also decided to reject the request of the defendant Jaeld Çela for the replacement of the security measure “Prison arrest”. Saimir Tahiri and the former head of the Vlora Police, Jaeld Çela, were found guilty of the criminal offense of “Abuse of Duty”.
The former minister was sentenced to three years of probation, while Jaeld Cela to three years and four months in prison. In November 2017, the Prosecution accused Cela of collaborating with Tahiri in aiding the Habilaj gang to traffic drugs.
Cela turned himself in to police in May 2020 – after two years on the run. While he was charged with the criminal offenses “Cultivation of narcotic plants”, “Trafficking in narcotic plants” and “Structured criminal group”.
The Serious Crimes Court only charged Cela with abuse of office and sentenced him to 3.4 years in prison.
On the other hand, the former minister was sentenced to only three years of probation on the re-qualified charge of “abuse of office”. it was also decided that, for at least a few years, he would stay out of political life. This decision of the Prosecution was appealed by Tahiri, who took the case to the Supreme Court.
