Prosecutor Sonila Muhametaj’s case file has been returned to the Administrative Appeal.
The decision was given in the advisory room by the administrative panel of the Supreme Court.
The High Prosecution Council previously decided to appeal with recourse to the Supreme Court to oppose the court’s decision that gave the right to Sonila Muhametaj and ordered the ranking once again of the three candidates Muhametaj, Alfred Shehu and Elvin Gokaj.
With the request for suspension of the execution of the decision and annulment of the decision, the KLP refused to obey the final decision of the Administrative Appeals Court that questioned four decisions taken in one day by the government of the prosecution to raise career and to take two prosecutors to SPAK and to disqualify Muhammad.
At the time when the court emphasizes that the exclusive right to send prosecutors to SPAK belongs to the KLP, the court criticizes the government of prosecutors for not respecting the procedure and flagrantly violating the legal principles.
The Administrative Court adds that the acts for sending the two prosecutors to SPAK, Shehu and Gokaj, are absolutely invalid. However, KLP’s recourse to the Supreme Court saves them for the moment from the suspension to undergo the scoring again in front of Sonila Muhametaj. And so does the KLP, which leaves the case in a court that has a stock of 36 thousand files.
Including Gokaj and Shehu, currently SPAK has 17 prosecutors, but Muhametaj, a prosecutor with 17 years of career and who insists that the selection of rivals was influenced, continues to target one of these places.
