The President of the Republic of Albania, Ilir Meta on Friday declared in front of the journalists that the institution of the President has started the procedures for setting the date of the elections in those Local Government Units that are currently left without a mayor.
Meta’s statement preceded a letter sent to the head of the Central Election Commission, Ilirian Celibashi, according to which the institution of the President of the Republic emphasizes that this situation can not remain unresolved, despite the fact that many actors may be interested this status quo.
The President says that even after the issuance of this decision of the Constitutional Court, which due to the declaration of lack of constitutional jurisdiction, in essence does not create any obligation to act for any institution, again the situation of exercising executive power in local government is absurd, where some municipalities of the country are governed without a mayor, thus creating a path for irresponsibility, abuse of public power, and failure to provide quality services to citizens living in those local government units.
The letter underlines that by concluding that these institutions provided by the Constitution (Municipalities without a Mayor), are not functioning properly, and meanwhile the parties and actors that have the obligation to resolve this situation, have not yet taken any concrete steps, and it does not seem that they have any will to resolve it, pursuant to Article 92 / h of the Constitution, is addressed to you with this letter to receive official information from you on this question:
Who exactly are those Local Government Units (Municipalities), in which during this period 30 June 2019 – January 2022, according to your information and assessment, the mandate of the Mayors has ended prematurely? What is the legal reason and the act through which the early termination of the mandate was realized and for the fulfillment of which it is necessary to organize by-elections for the mayor, in accordance with the provisions of the Electoral Code of the Republic of Albania?
According to the President of the Republic, in the letter sent to the head of the CEC, this situation was created due to the decision of the Constitutional Court, which decided to reject the submitted request, as according to it the request of the Association of Albanian Municipalities is not part in constitutional jurisdiction, thus declaring itself incompetent to review these cases.
For the President, such a decision, thus declaring the absence of constitutional jurisdiction, in fact left this issue without a final solution, by not entering at all into the examination of the merits of the allegations on the unconstitutionality of the electoral process held on 30 June.
