The inmate for murder, who died from Covid-19 in prison the day before, was awaiting the commutation of the remaining sentence from the court.
Andrea Berberi, a 76-year-old prisoner from Durrës, had requested a reduction of his sentence without serving his sentence, and January 18 was set as the day for the review of his request.
The barber died, but despite this circumstance, Judge Besiana Gërxanaj decided to dismiss the case for territorial incompetence, as the applicant was serving his sentence in the Rrogozhina Penitentiary Institution, where he was transferred, so the request for reduction of the sentence must be reviewed by the Kavaja Court.
The 76-year-old was serving his sentence in Peqin prison 10 years ago, when he was found guilty of premeditated murder of a 42-year-old neighbor.
The crime with the motive of revenge took place on November 21, 2011 in the Hospital of Durrës. The barber fired a barrage of bullets, firing two cartridges at 42-year-old Luan Puja.
The incident happened for revenge motives. A few months before the murder, in March of that year, the Barber was raped with fists and an iron lever by the victim for a banal conflict between them.
Classified as a minor injury, the case had ended in court, but on November 9, 2011, 12 days before the murder, the Durrës court had decided to suspend the prison sentence of Puja and leave him on probation for 18 months.
Dissatisfied and convinced, as he had stated in court, that Puja wanted to kill him, Berber decided to do justice himself. After killing in the middle of the street and throwing a gun demonstratively at the victim’s body, Berber was arrested a few minutes later at his home.
On September 18, 2012, the court of Durrës found him guilty and sentenced him to 25 years in prison and a fine of 500 thousand ALL. While serving his prison sentence, Berber did not stop demanding a reduction of his sentence.
On November 18, 2019, Barber had received a 90-day sentence reduction and after that he had again requested a sentence reduction.
Following the court decision, the request of the deceased to reduce the sentence seems to remain open for declaring incompetence.
