An elderly woman from Elbasan complains on the show Fiks Fare that justice has found her son guilty, after he lost his life in an accident.
The woman tells the reporters of Fiks that 7 years ago, her son Gjergji Panxhi, 33 years old, was the victim of an accident. He was traveling on a motorcycle with his cousin, when they were hit by a truck which was entering the premises of OSHEE.
The old woman with tears in her eyes confesses that her son was not guilty of this accident, but according to the investigations carried out by the prosecutor Platin Alicka, it turns out yes.
The lady does not trust the Albanian justice and asks for the help of Fiks Fare, as she thinks that the prosecutor has not investigated at all.
Fiks journalists meet the expert Gëzim Hoxha who is also the President of the Association for Aid to the Accident. The expert reconstructs the scheme of the place where the accident occurred. At the same time, he explains to Fiks that based on the act of expertise, the culprit for the accident is the driver of the truck and not the victim.
According to the expert, the truck mistakenly cut the road to the motorcycle with which the victim was traveling. In violation of Article 152 of the Road Code. Fiks reporters at the scene also meet a witness who was called at the time of the accident by the prosecution to testify about the event. He points out that the van and the engine were running in parallel where it was obvious to the naked eye that the engine speed was lower than that of the van.
The witness also confessed that the victim was lying at the point where the expert had placed him along the set up of the accident scheme, but the police were too late to reach the scene. Journalists also meet with the lawyer of the case. Pointing to Fiks that according to him the victim is not guilty despite the fact that all levels of the judiciary have given decisions against, lawyer Ilia Gugu says that the last move remains recourse to the Supreme Court.
Meanwhile, from the various acts of expertise, the lawyer extracts another detail. The photos taken at the scene show that the truck did not have a mirror on the passenger’s arm where it collided with the engine. The expert report states the opposite, that the mirror was found hanging by the investigation team at the scene. Also in an expert report it is stated that the truck violated Article 152 of the Road Code, but in the decision of the prosecution this is not mentioned.
In the file provided by Fiks Fare revealed that there are three norms of blood alcohol for the victim.
Initially, after the analysis performed at the Institute of Forensic Medicine, the victim resulted in 0 gr / l of alcohol in the blood.
After a few days the same doctor repeats the analysis of the percentage of alcohol in the blood of the victim, arguing that the first rate is wrong due to a problem they had with the apparatus that measures the rate. In the second analysis, the level of alcohol in the victim’s blood came out to be 1.282 gr / l.
Faced with 2 different norms, the prosecution decided to repeat this analysis with the blood sample located at the Institute of Forensic Medicine.
In the third analysis of the same blood sample, the level of blood alcohol percentage increased. This time it turned out that the percentage of alcohol in the blood was 1.364gr / l
So for the same blood sample, the tests performed in the same laboratory, came out with 3 different values of the presence of alcohol, where the victim came out more and more alcoholic.
