Julian Laboti from the city of Lushnja in 2019 through social networks, specifically Facebook, applied for a work visa in Germany to an agency called “ALBANIAN EMPLOYMENT AGENCY”.
This agency through an act-agreement promised Julian a work visa as an electrician, but the latter had to pay 700 euros in exchange for the company to start the application procedures. Julian met all the conditions for the application, but since then, although Julian has repeatedly asked for communication opportunities with the agency representatives, they responded by saying that the procedures were being delayed due to the pandemic and as a result the German embassy closed the applications.
After Juliani asked for the help of the show “Fiks Fare”, they directed him to the premises of ASHP where he talked with the main administrator of this agency, Mr. Ylber Gjeta, according to him, a lawyer by profession.
The finding was justified to Julian by telling him that the reason for the delays in the proceedings is the pandemic and that the embassy has closed the meetings since last year and it is very difficult to intervene. But in a conversation between the two it turns out that Mr. Gjeta could send people to Germany for employment but already the value has reached the figure of 4000 euros.
Juliani, unable to pay, plus that he owed 700 euros paid 3 years ago, asks the administrator to return the money, but this has angered Ylber Gjeta because according to him, these 3 years he had worked and spent for the client (in the case specific whistleblower), plus the costs of the agency staff who dealt with his case.
But Julian’s three-year wait came to an end by seeking to get back the money deposited in this agency to sign an employment contract. Initially, the administrator informs them that if he withdraws, only 400 euros will be returned to him, as the rest will be kept for the work that was done during these 3 years of the pandemic.
Julian’s question what he has done in these three years is answered by the administrator raising his voice in his office, and justifying that in the agreement that Julian had received from the beginning there was no time limit. But the administrator Gjeta escaped the fact that Juliani really has the agreement and the payment mandate but had not signed it. After much debate in the administrator’s office both sides agree by returning the euros to Julian.
“You will file a request now that you withdraw and you will receive the money 60 days after this request,” says Gjeta. But when asked by Julian why he could not get the money in advance, the administrator replies that this is how it works plus that he did not have it that day because he had returned it to some other clients who had asked to withdraw. The journalists of “Fiks Fare” addressed the offices of ASHP and Mr. Gjeta, except that this request for contract termination had not been signed and stamped by him, he said that he would return the money to Julian at the moment.
