Kadri Malka from Korça complains on the show Fiks Fare about the way in which the accident in which his 5-year-old nephew died was investigated and tried.
In 2017 in Kombinat, his nephew was crushed by a vehicle resulting in death. The minor is found under the tires of a van having blows which have also caused his death. But the acts of expertise made on the event speak differently and both guilty find the 5-year-old minor.
Mr. Malka says that there were violations in the way of investigating the event. He explains to reporters that two expert acts have been carried out. The first act of expertise states that the child was inserted between the tires of the van, but there were no serious injuries. The second act states that the child’s head was found behind the van tire, but again not very damaged.
And according to this act the tire has made a half turn over the head of the child and according to experts the head of the minor is just scratched. These experts also conclude that it was another vehicle that hit the child resulting in death, and that he left the scene. While the driver who was in a drunken state was released exactly by this act of expertise and had no legal consequences.
“But how can a van tire not hurt so much when it goes overhead?” rightly asks the grandfather of the deceased 5 year old. He also explains that in the act of expertise it is stated that the driver was drunk, but was walking at a speed of 20 km per hour and braked. The braking distance is marked 1.9 meters which can not happen. But above all, says Mr. Malka, in the acts of expertise it is said that he was the child who violated the law! “How can a child 5 years and 7 months break the law, this can not happen in any country in the world,” says the citizen from Korça.
Seeking justice, Mr. Malka has addressed all legal instances of the state and the answer he has received is that the car that hit the child has not been found yet. For this reason, a letter was sent to Commissariat No. 6 in Tirana by the prosecution to find the vehicle that crushed the child. Awaiting a response from the police station, the prosecution has suspended the investigation.
The two acts of expertise put the child in two different positions. According to them, the cause of the accident was another vehicle and not the driver or van that the child found near the tire. The court has decided to remand the investigation. Following the court decision, the Prosecution has suspended the case, charging Commissariat no. 6 to find the other driver who, according to them, hit the child.
