All couples who have ended their marriage by mutual understanding can get divorced at a notary.
This discussion has involved justice actors and has been triggered not only by the flow of files waiting in the courts, but also by the fact that many couples are currently appearing at notaries to sign an agreement on separation.
Notary Elona Saliaj, who has undertaken such an initiative with interest groups, insists that by avoiding the court for consensual separations, citizens are ensured justice without delay.
“Yes, there are practices, and not far from Greece, our neighbors are France, Spain, Latvia, Romania and Estonia. There are some of the countries that have already defined the dissolution of marriage with mutual consent at the notary and accelerates the relevant procedures. It is a necessity of the time, it is a relief for the citizens, but it is also a service which must be flexible in order to serve the customers”. said Elona Saliaj, notary.
With this act of agreement that is signed at the notary, then the document is submitted to the court and it approves it.
In the draft notarized agreement, the former partners detail parental responsibility, meetings with the children according to a weekly and annual calendar, but also other obligations that they take on of their own free will.
“There are about 7,000 divorces in the Republic of Albania, where it is understood that most of them are by mutual consent or with the full will of both spouses. It is understood that there is an added cost to them because the spouses cannot go to all the divorce hearings and they appoint lawyers, which means costs. They define a special power of attorney, make a draft agreement, then wait for days and months, which can roughly be three months or a year.”says the notary.
Excluded from this proposal are those couples who are separated by war and who mainly fight over children and property.
