The People’s Advocate reacted regarding the protest of the residents of “5 Maji”, who oppose the demolition of their apartments.

The Institution of the People’s Advocate, as it has informed and previously followed, has continuously and with concern the problem in the demolition of the apartments located in the Administrative Units no. 8 and no. 4 areas “5 Maji”, Tirana, from the intervention of IMT structures near the Municipality of Tirana in implementation of decision no. 533, dated 22.09.2021 of the Council of Ministers on expropriation for public interest, in function of the reconstruction process for the development of the area of re, in accordance with the mandatory local plan, through exchange compensation for all assets affected by the implementation of the project “For the new development zone an administrative unit no. 4 and 8, zone” 5 May “, Municipality of Tirana”.
The problem has been presented by a group of residents of Administrative Unit no. 8 and no. 4 Tirana for demolition of their apartments at the Institution of the People’s Advocate on dt. 26.10.2021. Upon receiving the complaint, the assistant commissioners of the Administration Section in the institution of the People’s Advocate, on dt. 26.10.2021 followed in the field the problems that accompanied the action of the structures of the Municipality of Tirana, IMT in the demolition of buildings / houses located in Unit No. 4 and 8 areas “5 Maji” Municipality of Tirana.
Residents object to the demolition of their homes on the grounds that the Municipality of Tirana first lacked transparency regarding the acts produced by the Municipality of Tirana, specifically the Property Exchange / Donation Agreement which is not detailed with the relevant data and without information what is the property that will be made available to the residents in exchange for the property received within the development of the area.
Through this complaint the residents claim that they were notified only about the release of the facilities on the specified date but have no further information regarding their accommodation. Residents say that their apartments are being taken away, but the Municipality of Tirana and subordinate structures have not announced the procedures that will be followed to guarantee housing after the release of their buildings.
In the conditions of such a situation, the Institution of the People’s Advocate was set in motion to investigate the entire procedure followed by the competent bodies in a clear definition of the situation created. Through the correspondence with the Municipality of Tirana in the framework of this investigation was requested detailed information on the reasons why this Municipality has reached the conclusion that the expropriation of the inhabitants of these buildings / objects located in the administrative units no.4 and no.8 Municipality Tirana is the only means to achieve the relevant public goal in this case for the development of the area.
The interest of the Institution of the People’s Advocate, the Municipality of Tirana and the relevant structures has not been responded to in time and further the information presented is general without argumentation and documented with the relevant acts.
While the People’s Advocate evaluates as positive the position expressed in the above-mentioned DCM on the possibility of providing an apartment / flat to all residents affected by this project, he first draws attention to the truncated transparency that has accompanied the compilation and execution of this the decision, which has also caused a visible state of uncertainty, uncertainty and concern for citizens.
The People’s Advocate also draws attention to some clauses of this decision, which due to the procedures followed to justify the emergency created by the 2019 earthquake, today in 2022 do not offer sufficient guarantees for citizens affected by the demolition of buildings. they are evasively promised a non-individualized and non-fixed form of compensation.
Following the investigation, the representatives of the People’s Advocate Institution have been present on the ground again today during the IMT interventions in the demolition of houses in this area and will continue to follow this problem until all issues are clarified. in respect of the law and the rights of Albanian citizens.
