The President of the Republic, Ilir Meta on April 19, 2022, has administered the proposal of the High Judicial Council, for the appointment of Mr. Darjel Sina as the youngest member of the High Court, who has been selected to be appointed through the selection procedure for appointment to the High Court, of candidates from the ranks of prominent jurists, for the vacant position in the field of civil law.
The President of the Republic after getting acquainted with the decision-making of the High Judicial Council and the proposal forwarded by this body, together with the documentary practice of appointment to the High Court, from the ranks of prominent lawyers, for the vacant position in the field of civil law , found that the filling of this vacancy has been announced for application since September 11, 2019, with decision no. 172 of the High Judicial Council (HJC).
At the end of the review of this proposal, the President of the Republic, pursuant to Article 93 and Article 136 of the Constitution, Article 48, points 11 and 13 of Law no. 96/2016 “On the status of judges and prosecutors in the Republic of Albania”, as amended, has accepted the proposal of the HJC, and through Decree no. 13573, dated 26.4.2022, has decided that:
• Mr. Darjel Sina to be appointed a judge in the Supreme Court, from the ranks of prominent lawyers.
With this new appointment, from today the Supreme Court is made with 12 (twelve) judges, out of 19 that this court should have.
“The President of the Republic, despite this decree, strongly reiterates his reservation regarding the activity of the High Judicial Council, on the delays in filling the High Court with all the necessary judicial body.
The filling of this vacancy in the High Court has lasted exactly 2 (two) years and 7 (seven) months (September 2019-April 2022) which shows that the duration of the procedures followed by the HJC is unacceptable, beyond any legal deadline. and reasonable.
Although the President of the Republic, officially and through public messages has requested and has repeatedly called for the priority follow-up of the procedures for filling vacancies in the High Court, again the facts show that the HJC and / or institutions involved or related to this process have acted outside of this priority.
However, in support of the Constitution and with the will for the Supreme Court to be fully functional with all its necessary body, where thousands of files and fate of citizens await the trial for years, of the vital need that the country has for a High Court fully functional, as well as appreciating the verification and evaluation by the HJC of the proposed candidacy, the President of the Republic has decided to express without delay the acceptance of the HJC proposal, for the appointment of Mr. Darjel Sina, as the youngest member of the High Court. ”- it is said in the announcement of the Presidency.
