The Democratic Party on Saturday appealed the decision of the Election Commissioner, Ilirian Celibashi for the registration of the coalition “House of Freedom”, in the by-elections of March 6. The complaint was submitted to the Complaints and Sanctions Commission at the CEC by the DP legal representative, Marash Logu.
In their complaint, the DP states that the request submitted to the CEC by the SMI for the registration of the coalition was illegal, as the Re-establishment Commission and the PDK were not registered as a party for the local by-elections.
“The Electoral Code clearly defines how an electoral coalition can be registered only by two or more political parties registered as electoral subjects in the CEC“, Is quoted by the request.
DP, underlines, that the Re-establishment Commission does not exist registered even as a political party.
According to her, the Regulatory Commission has clearly foreseen that the request for registration of the electoral coalition is submitted within 24 hours from the approval of the requests for registration of political parties. Therefore, the DP emphasizes that the election law and bylaws issued in its implementation, do not recognize concepts such as “ahead of time”, but only within or outside the deadline.
Based on this fact, PD says that the request submitted by the Socialist Movement for Integration lacked the quality of the electoral subject, which means that neither she nor other political parties, in this case PDK, are not legitimized to submit this request.
Democrats point out that in the February 4 decision, the CEC acknowledged that on February 3, no request for registration of coalitions was submitted, but surprisingly, according to them, even in the absence of this request, the Election Commissioner decides to register this coalition, invented according to the DP a new terminology, without reference to the Albanian legislation, a request submitted “ahead of time”.
On Friday, the CEC decided that the Re-establishment Commission should remain outside the ‘House of Freedom’ coalition. According to the CEC, the name of the Democratic Party Re-establishment Commission will not be recorded on the ballot paper and in any document.
On February 1, the Socialist Movement for Integration submitted to the Central Election Commission a request for registration of a coalition with the Re-establishment Commission and the PDK for the March 6 elections.
