The Supreme Court gave the Biden administration the green light to end the Trump-era “Stay in Mexico” policy, which forced tens of thousands of immigrants to stay in Mexico to await US hearings on their asylum applications.
The judges, in a 5-4 ruling authorized by Chief Justice John Roberts, overturned a lower court ruling requiring Biden to resume Trump policy.
The ruling strengthens Biden as he pursues what he calls a more “humane” approach to the southern border, even though Republicans blame him for causing an immigration crisis.
The judges concluded that the 5th Circuit Court of Appeals of the United States based in New Orleans erred in finding that federal immigration law required the sending of migrants to Mexico as long as there was not enough room to ‘kept them in the United States.
The Trump administration adopted the policy, officially dubbed the “Immigrant Protection Protocols,” in 2018 in response to an increase in migration along the U.S.-Mexico border, changing long-standing U.S. practice.
