British Prince Andrew has asked a judge to drop the rape lawsuit against him of Virginia Roberts, the former sex slave of the infamous financier Geoffrey Epstein, claiming the girl was not underage.
Already 38 years old Virginia, accuses the 61-year-old prince of sexually assaulting her three times when she was 17 and has filed a lawsuit in New York since August.
She sued under the “Minor Victims” clause in the US, which allows abusers to be sued at any time if they were under 18 when the crime occurred.
A member of the British royal family has asked the judge to drop the lawsuit, claiming the legislation is “unconstitutional” and arguing that “the issue of admission is unclear”.
His lawyer said today that the Minor Victims Act is not a credible mechanism for resolving the injustices of victims of sexual abuse as it defines them as under 18 years old, when in New York the age of admission is 17 years old ”.
The prince’s lawyers wrote that the accuser in the ‘lack of panic’ case should be considered a “deliberate threat”, but there are no third parties who can testify to this.
The lawyers wrote: “Here the only witnesses to the implied threats that Giuffre be involved in sexual acts without consent with Prince Andrew are Epstein (dead), Maxwell (prisoner), Prince Andrew (the accused) and Giuffre himself. “
Virginia Giuffre stands by her accusations, saying that the prince “was an abuser and a participant”.
The decision on the trial has not yet been made.
