It took a ten-year court battle with the Albanian institutions for a former convict, who sought compensation from the state attorney and the Shënkolli prison, in which immediately after he was arrested, he was attacked by another prisoner and was seriously injured.
The Supreme Court ordered that the ex-prisoner be compensated for the physical damage caused to you because the institutions had a duty to protect him.
The former mayor of Rrethina Municipality, Kleves Muja, and seven members of his family will be compensated by the Albanian state after the prison police were found guilty of not guarding him when he was handed over to be sent to the cell after his arrest.
At the age of 37 at that time, Kleves Muja was sent to prison as wanted for drug issues, but in the landing between the second and third floors he was attacked by the high security convict Xheladin Kruja.
For this event, five prison police officers who were found to have abused their duty while escorting the arrested were declared guilty of abuse of duty.
A security camera confirmed that the convict was assaulted by an inmate and that he was subsequently sentenced for this action to over 16 years in prison for attempted murder.
The court assesses that the prisoner was not only harmed in health but also financially and morally, the same as the harm that his relatives suffered afterwards.
