The opposition has demanded a hearing on the new court map, which has been opposed by the Chamber of Advocates.
Today, PD deputies Dhurata Çupi, Enkelejd Alibeaj, Gazment Bardhi, Saimir Korreshi, Bledion Nallbati, Dashnor Sula, Greta Bardeli, Fatmir Mediu, have requested a hearing session with the High Judicial Council, the High Prosecution Council, the Minister of Justice, the Minister of Justice National Advocacy, the People’s Advocate and the Albanian Helsinki Committee.
Lawyers in Fier, Kurbin and Korça have announced a boycott of court hearings, emphasizing that they are directly affected by this together with the citizens.
Opposition MPs say that they have followed closely the discussions that followed the decision of 10.06.2022 of the High Judicial Council for the approval of the “New Judicial Map”.
Deputies have received messages from various citizens expressing concern about the closure of courts in their cities.
“Particularly worrying is the situation for residents who will have to travel for miles or hours to reach the competent court to try their case.”
According to the opposition MPs, the judicial reorganization is related to a fundamental right related to access to justice, guaranteed by Article 42 of the Constitution of Albania and Article 6 of the European Convention on Human Rights.
The day before, the Steering Committee of the Albanian Bar Association asked its members to boycott all court proceedings, with the exception of precautionary measures planned for trial, at all levels of the courts, including the proceedings planned in The Supreme Court from 14 to 17 June.
According to the Chamber of Advocates, the new court map is in grave violation of the fundamental rights and freedoms of the individual, specially protected by the Constitution.
This decision is emphasized in the reaction of the Chamber of Advocates severely violates and limits the access to justice of the individual as well as the process of realization of protection in criminal, civil and administrative cases.
Lawyer Saimir Vishaj came out against the decision to boycott, saying that the deadline for this strike is very short and the damage it could cause in relation to its purpose is relevant.
Lawyers say they can not provide their service to citizens as there is a lack of infrastructure and the inability of citizens to move.
The decision to draft and implement the new court map has received opposition from business and notaries, calling it a very radical step.
The new Judicial Map provides for 12 courts of general jurisdiction and one Court of Appeal in Tirana, so 10 courts are expected to be merged.
