The Chamber of Advocates opposes the new court map that has fewer appellate courts in the districts and in protest demands a boycott of trials from Tuesday to Friday.
The Steering Committee finds and presents to the whole public that the decision to approve the new court map is in serious violation of the fundamental rights and freedoms of the individual, specially protected by the Constitution, said in a statement of the Chamber of Advocates.
“This decision severely violates and limits the access to justice of the individual as well as the process of realization of protection in criminal, civil and administrative cases. We note with regret that this decision is in line with and in support of a number of violations found in criminal, civil and administrative proceedings conducted in courts of all levels.
This decision openly ignored all the problems and arguments put forward by the governing bodies of the Central and local Chambers during the process of discussing the draft at the national level, a fact which clearly showed the formality, prejudice and abuse in not considering the opinion of stakeholders, including the Albanian Bar Association as one of the main actors in the justice delivery process.
Based on this situation, the Albanian Chamber of Advocates calls on the Minister of Justice and through him we ask him to convey to the government, as a decision-making institution, all the arguments presented in defense of the interests of natural and legal persons, concluding the non-approval the above decision submitted by the High Judicial Council ”.
In these conditions, the General Council of the Albanian Bar Association has decided tboycott all court proceedingswith the exception of precautionary measures, planned for trial, at all levels of the courts, including the processes planned in the High Court from 14 to 17 June.
The day before, the High Judicial Council said “yes” to the closure of 18 courts in the country, for which in the final, the final word belongs to the council of ministers.
The deepest reform of the reduction of courts is undergone by the courts of appeal of general jurisdiction, all of which are closed and all convened in one appellate court based in Tirana.
At the same time, the administrative courts of Vlora, Shkodra, Korça and Durrës, which previously covered the territorial jurisdiction of eight cities, were closed. The administrative court of appeal, which will continue to be the only one based in the capital, remains intact.
Opened during 2009 with the aim of establishing rapid justice for citizens who file lawsuits against the state, these courts meet in Tirana and Lushnja. Meanwhile, the courts of Kavaja, Lushnja, Kurbin, Pogradec, Tropoja and Kruja are closed by the courts of first instance.
But justice despite the reorganization is far from the number of 408 judges it should have in office. The only ones with the right number are the judicial staff of 1140 such.
This decision is immediately forwarded to the High Prosecution Council, the Attorney General and the Minister of Finance as the authority reviewing the budget.
