Following the communication about the event that occurred on 04.05.2022 in the Kavaja Police Commissariat, where the citizen IM was found dead, the Regional Directorate of AMP Durrës-Kavaja has completed the preliminary investigation which has resulted as follows:
On 04.05.2022, around 19:00, in the security / detention / arrest rooms, at the Kavaja Police Commissariat, the arrested citizen IM, 31 years old, committed suicide by using the hood of the shirt he was wearing, wearing found later and death.
The forensic experts examined the victim and it turned out that no signs of violence were found on his body.
Preliminary investigations have shown that the employees who had the task of supervising and keeping in control of the citizen IM during the time he was accompanied / detained in the premises of the Kavaja Police Station, have not fulfilled the obligations arising from Law 108/2014 ” For the State Police ”and the Standard Procedure“ Treatment and security of persons arrested / detained in the premises of the State Police, identification and resolution of their request / complaints ”approved by Order no. 925, dated 19.07.2019 of the GDPR.
After receiving and evaluating the evidence within this investigation, it is suspected that these employees with their actions and inactions have abused their duty, by not taking measures to prevent the event.
At the end of the preliminary investigation, the Police Supervision Agency (Regional Directorate of AMP Durrës-Kavaja) has arrested in flagrante delicto 3 police officers, suspected of committing the criminal offense “Abuse of duty”, provided by Article 248 of the Criminal Code of specifically:
- Deputy Commissioner BP, acting Specialist of the command room, at the Kavaja Police Commissariat;
- Inspector BB, on duty duty service, general patrol at the Kavaja Police Commissariat;
- Inspector RK, on duty in the security rooms at the Kavaja Police Commissariat.
The procedural materials have been forwarded to the Kavaja Prosecutor’s Office for further investigation.
