The Tirana court has accepted the request of the Re-establishment Group for changes to the PD statute based on the December 11 assembly held by Sali Berisha.
The news is confirmed by lawyer Ivi Kaso. The decision was given by Judge Agron Zhukri. The legal representative of the Re-establishment Commission, Ivi Kaso spoke to the media after the decision of the Court of Tirana, saying that the decision was made to recognize the re-establishment group as the leading body of the DP.
Ivi Kaso: The court today took the decision and decided to return to the Democrats their party with the new logo and symbols, and to take important decisions, such as the dismissal of Lulzim Basha, the non-recognition of the constitution of the Presidency, the recognition of the Re-establishment Commission as the only official body of the DP that represents it until the Assembly of April 30. What we have said from the beginning has been formalized. It’s a belated decision that should have been made within a month but better late than never.
How legitimate can this decision be?
Ivi Kaso: As of December 11, there is only one DP represented by the Re-establishment Commission. This is already certified by a court decision, whether they like it or not those who have thrown smoke. There is no request of the former representatives to unite the issue of the July assembly with the December assembly. There are 2 separate cases being tried by different judges. There is still no request for the December 18 assembly. If we are going to talk about the famous complaint, it was filed before the appeal deadline started. This is a complaint that has to do with another issue than that of Mr. Zhukri. It is a complaint submitted before the deadline and is the same as a complaint after the deadline but is reviewed by Blerina Muca, has nothing to do with today’s issue. Today’s issue was not hampered by any other issue.
The decision was given today, at the moment the decision is made, the decision is thrown and we will receive a copy that the registration of the statute of December 11, the placement of new seals and all the decisions of the Assembly of December 11 have been decided. The decision has entered into force. Now legally, the PD headquarters will be headed by the re-establishment group. The Democratic Party, as of today, has only one official governing body, as the court says today. I do not understand who will not implement this court decision. There is only one PD and only one symbol, one flag and one stamp that we have deposited after the December 11 Assembly.
For illegal adventures and madness, I can not answer.
Asked if Judge Zhukri had received the file from the Court of Appeals, Kaso said:
“How can trials be held without files. Go verify and tell me at least one other case for the court to try without a file. The court had 2 files, not only the voluminous files but also the file of the historical register of PD. All were available to the court. “Stupidity for trials without a file, whoever says let him keep it.”
What happens if the court decides on the statutory changes of December 18?
Ivi Kaso: If you would be curious to see the important decisions of the Assembly of December 11, one of the decisions is to cancel the call of December 18 as illegally convened by an unconstitutional chairman. This decision has already been registered, ie the annulment of the Assembly of December 18. Today’s decision could only be appealed by our party.
