The European Union has condemned the actions of the Republika Srpska Assembly – an entity in Bosnia and Herzegovina – which it says lead to the creation of a separate judicial and prosecutorial council.
According to the EU, this action “represents an unacceptable violation of the constitutional and legal order of Bosnia and Herzegovina”.
“If this law is passed, it will have serious consequences for the rights of the citizens of Republika Srpska, will deepen legal uncertainty and instability in the country’s legal system, and will seriously damage Bosnia and Herzegovina’s European perspective,” he said. in the communiqué issued by the european bloc.
Republika Srpska together with the Muslim-Croat Federation are the two entities that make up Bosnia and Herzegovina.
Such an organization was made with the so-called Dayton Accords, which ended the war in Bosnia in the 1990s.
The country is governed and administered along the ethnic lines set out in the Agreement, and has a central government, which is often dysfunctional.
The draft law on the establishment of this council in Republika Srpska, which lawmakers backed in Thursday’s session, is unconstitutional because it transfers competencies from the state level of Bosnia and Herzegovina to the level of the Republika Srpska entity.
Such a decision, ie the transfer of competencies from the state level to a lower level of government, can only be taken by the Parliament of Bosnia and Herzegovina.
The European Union (EU) has called on leaders in Bosnia and Herzegovina, especially those in Republika Srpska, to take steps to increase tensions and ensure the resumption of a serious dialogue within state institutions, in order to address their concerns. for leaders to focus on reforms that would ensure overcoming the crisis and meeting EU criteria for candidate status.
The European Union has this time warned of measures it can take against those who endanger the unity of the country and the functioning of institutions.
“The EU High Representative for Foreign Affairs and Security Policy has put the situation in Bosnia and Herzegovina and actions that undermine the country’s unity on the agenda of the next meeting of the Foreign Affairs Council,” the statement said. of the EU.
When the United States imposed sanctions on the Serb leader in Bosnia and Herzegovina, Milorad Dodik, the idea was presented in the EU that the European Union should follow the same path.
This idea was also presented by Germany. But in the EU there has been no agreement from all member states on such a thing, because they want to enable dialogue.
However, now the pressure is growing for the European Union to take action against those it sees as responsible for endangering the unity and sovereignty of Bosnia and Herzegovina.
Milorad Dodik has in the past threatened the secession of Republika Srpska from Bosnia and Herzegovina.
