Applications for the vacant position in the Constitutional Court have been opened, while the Albanian Parliament has initiated the procedures for convening applications.
Announces the opening of the application procedure for the vacant position (full vacancy with a 9-year mandate) for 1 (one) member of the Constitutional Court, in order to fill the vacancy created due to the declaration of termination of the mandate of the member Mr. Altin Binaj, on 02.05.2022, announced with decision no. 41, dated 22.12.2021 of the Constitutional Court ”, it is stated in the notification of the Assembly.
The Constitutional Court currently has only four full-time members: Elsa Toska, Fiona Papajorgji, Marsela Xhaferllari and Sonila Bejtja. The Constitutional Court should have 9 members, although decisions can be made by 5 votes in favor.
It is important to underline that the 2 judges whose mandate has ended, Përparim Kalo and Altin Binaj, will remain in that position according to the law, until their replacement.
Criteria to be met by candidates
have full capacity to act;
have completed higher legal education, Second Level Diploma;
has not exercised political functions in the public administration and has not held leading positions in political parties during the last 10 years from the date of candidacy;
not to be in criminal proceedings and not to have been sentenced to imprisonment for committing a criminal offense;
not to have been removed from duty for disciplinary reasons and not to have a disciplinary measure in force;
to have successfully passed the process of control and verification of his personal property and that of his family members, according to the law.
have work experience of not less than 15 years as a judge, prosecutor, lawyer, professor or law lecturer, senior lawyer in public administration;
have a recognized activity in the field of constitutional law, human rights or other areas of law;
be valued for professional skills and ethical and moral integrity.
The fulfillment of the above criteria is evaluated on the basis of: seniority in the profession; special experience of the candidate in a certain field of law, or legal advisor of the Constitutional Court or the High Court; postgraduate qualifications and training in the field of constitutional law, human rights or another field of law; scientific indicators, including scientific publications and articles in the legal field; progress in completing higher legal education, with an average grade not less than 8 or equivalent, if higher education has been completed abroad or final assessment in the School of Magistrates; information received from other public institutions.
